So, for any one having this issue during patching if you have an extra hard drive in your computer just move the install and temp files to that OR make a folder any where on your main drive away from the default location everything will normally go.

Try install the game in Windows Safe Mode, it worked for me.

you uninstalled the game then reinstalled with windows rebooted in safe mode with networking? or did you try the harddisk thing?

Both. I have tried both solutions neither have worked.

Only other thing I can think of is turning UAC off for the install / unloading the antivirus.
