Nope, I just tried that and apparently the penalty for unknowingly splitting up a group is to be alpha struck in the back until you are at critical damage.
The dudes didn't even SAY ANYTHING until after I asked them what was up, which was several seconds after the second salvo (I had assumed the first was just typical early game misfire derpiness).
Understandably (I think), I was somewhat reluctant to give them command after having be shot without so much as a "give us command" first.
This apparently was enough to earn me the death penalty.
TLDR version: Taking command is SRS business. You might accidentally break up the gaming equivalent of the Beatles. Or something.
