Video Setting "low" Gives Me Worse Framerate Than Medium

I'm not sure if the settings are just mislabeled or if something else is going on.
I'm on Windows 7 with a Core i5-2500k CPU
I have a AMD HD 6970 GPU
I was doing this in Full Screen Mode with Vsync off.

post processing=effects

Started a new game. Apparently all my settings had been changed to "medium/high" (default?).
I ran at around 15fps and changed everything to low - my fps dropped to 7-8.
Undoubtedly the issue lies with my Intel Graphics 3000, but I usually run at 30+ FPS.

I saw "greater/better graphics" despite setting stuff to low/medium.

1)notice the textures as i swap between low and high
2)notice that while post processing is set to low ingame it does not apply. you can see the lightshafts the depth of field blur ect
3)notice that effects are set to high but in game missiles have no trails and PPCs have no extra effects around the "lightning"

Some settings reduce FPS when I lower the slider from medium to low, ie Shadows and Shading.
Some settings increase FPS when I increase the slider from low to medium, ie. Environment.
With the settings: low, low, low, low, medium, medium, medium, medium, off (in that order), I seem to have maximized fps.
... at 15 fps.
I know my graphics card is horrendous (intel graphics 3000), but I've never had issues (to this extent) before.

They give me approximately the framerates I had before the patch today.
