It's not spyware by definition. Though it is still pretty underhanded in how it does its job.
I do play games that use Pando for patches, and my normal tactic of dealing with them is having Pando blocked at the firewall until a patch is actually available.

this, plus i always disable it in the task manager... dunno about current versions, but recent versions have been heavy on reccourcesm even if it was not actively downloading...

Personally, I'm very leery about downloading a game that uses PMB in the first place, so it *really* has to catch my attention before I will. If one does, I just remove PMB from my system after I download a game that uses it. If the game wont run without PMB then the game was probably designed with purposes other than 'fun' in mind and also gets removed.
