GOG has a community wishlist in which you can vote on which games you want, and MW3 is currently at 9933 votes (more than any of the other Mechwarrior submissions), and plenty of games with fewer votes have been added. Throw a vote in, there is a decent chance they might update it for modern PC's and sell it!

One of the mektek devs mentioned when they were releasing MW4, that Microsoft mentioned they owned FASA's portion of MW2/MW3, but they weren't sure how much Activision & Microprose(now Hasbro) owned.

Although presumably no-one has yet gone through the legwork that Night Dive Studios did with NOLF. So someone would need to talk to the Microsoft lawyers, and the Hasbro lawyers.
