Well in this case, he's got the technicality that he hadn't actually accepted the NDA at that point. So it's sort of like me now saying I'm in the beta. I've not signed any NDA, so it's not a breach
It would be patently absurd to punish him for being excited like that. He has nothing to worry about.

apart of the nda you havent signed yet is that your not supose to tell anyone your in the beta or playing the beta (they shud say something in the email but they dont) so posting about that is very frowned upon i would imagine...just a heads up (i was totally un aware)
