No, that was never in question.
Harmony Gold (claims it) owns Macross designs, which are Phoenix Hawk, Warhammer, Marauder, Rifleman,...
Shadow Hawk is owned by Bandai (Gundam creators, I mean, Shadow Hawk itself is just the Gundam with a helicopter cockpit) and they are fine with the redesigns in MW:O as well as BT.

It likely means any of the unseens, regardless of where they came from, still can not be exact copies of the original mecha, simply inspired by them. FASA had pulled the other mechs not done in-house to prevent possibly future lawsuits, ie sharks in the water.

Actually the Shadow Hawk, Griffin, Wolverine, Thunderbolt, Battlemaster, Goliath and Scorpion all came from an Anime called "Fang of the Sun Dougram", which aired in 1981. You can buy reprints of the model kits on Amazon if you really like the original designs.

This anime is owned by Nippon Sunrise, yes, the Gundam makers, which in turn was acquired by Bandai.

There is also more to this anime because the more you look at it, the more it appears to be the prototype for Battletech itself.
