Consider that MWO is aiming squarely at the space currently occupied by World of Tanks
Take a look at what World of Tanks made in the last year, profit-wise.
Ponder whether the Project Phoenix designs are obviously derivitive of the originals.
Wonder whether the actual IP owners could have enough of a case to make it drawn out and painful.
And now put yourself in PGI's shoes, and ask yourself: Is it worth it? Not as a fanboy, not as someone who really wants to see those particular designs, but as someone who has to consider possible legal action if your game does really, really well.
My own answer? Not even a little bit. The Project Phoenix 'mechs are an abomination of ugly. The designs should have been left to the realm of eBay and those of us with old versions of the minis. I know everyone wants their Marauder or Warhammer, but really... the game won't live or die based on not including the Marauder, but it could very possibly live or die based on the legal impact of even a derivitive work. As much as the players may hate it - and believe me, I really, REALLY want a decent Thunderbolt - I doubt it's worth the risk.
