Each and everytime the client closes at the 40% mark, where it should finalize patch 1 of 2, nothing I do can get it to go past that point. Anyone got ideas?

This use to happen all the time to mast everyone. Make sure you turn off your antivirus. That is the stock answer here is my trick with Windows 7 when it starts open another program something small like a card game and play until the download is done this seems to help slow down the read and write and avoids corruptions I have talked 6 of the 15 guys in my unit through this and it has worked. Why exactly I can not say but the packing and unpacking may have something to do with it. Yes this has worked for XP 7 and 8. Good Luck if this does not work submit a ticket to tech support they I am sure have new ideas.

turned off avast it didnt work, I also ran a small program and it didnt work. then I ran everything to "slow" my computer down enough (like ffarr, wow, neverwinter, music, and several videos), and that didnt work (of course this is a 2 week old brand new custom computer designed to do all of that and not slow down, components like asus 760 dc02 video cards).
What else can i try, I do remember their tech telling me about an "assist" program part of avast to turn off because mwo just black screened all the time, but I dont remember what that assist program was, where its located at, or whatever I can try.
*and a note, this is getting on my nerves, as the other poster pointed out, this is NOT beta anymore, get your sh!t working*

I had the same problem so I ran the repair tool and it works now. It took a few hours though.

Please send a support ticket with your most recent patcher logs so we can see exactly whats going on.
what do you mean patch logs? the omnicron files? which oddly are saying dec 2013 and the most recent ones, after the jan 2014 ones.
