Founders Access and NDA

*DISCLAIMER: I'm NOT on the Beta*

Soon (according to some even in a few hours) all founders are supposed to get access to the closed beta.
Given that one of the NDA axioms is to not declare whether you're in the beta, will this make it void as general knowledge will be that all shiny badges have beta access?

Is the NDA going to be modified?
Do you think game information will start to circulate with a much greater degree of freedom?

An answer from the devs would be nice but player speculation is also welcome.

While the section of the NDA stating not to declare a person is in Beta MAY be striken, the rest will most likely stay until PGI declares open Beta.... if only to preclude a mass posting of screenprints, videos, and other steatements out to the web.....

and you may not see any Dev input.... until they decide the modify/drop the NDA..... just saying....

More game information as a result? Shouldn't be.

Here's why: Even if it becomes true that all founders have beta access, rendering that specific bit of the NDA moot for founders, it won't make it moot for other players, and it won't void the prohibition about game information.

(you wanted speculation, you got it).

Last I heard all founders should be in beta August 7th as that's when the hardware is supposed to come in.

Better safe then sorry. There is also Paul's famous beta filter so not ALL founders will be in.

Easier solution I think has already been found: there should be a beta section in the forums, for people who are in (founders etc.) you should be able to discuss freely matters of gameplay there. As more people will join, the leaks will increase, no doubt, but until the devs says "go and spread the word" we are bound to the nda.

Well i guess at first the NDA will still be going on. But at a point where are to much ppl playing it doesn't make more sense for an NDA as we see right now in the forum much ppl already break the NDA...

And i don't think the NDA will be modified coz it's a standart contract as i know, it's everywhere same.

Better safe than sorry indeed but as the number of people in will increase it's likely there will be a lot more people with loose lips, making enforcing the rules a lot more difficult.
I do take it very seriously (I used to be under NDA with Microsoft, although not in MW-related matters) but many others won't...

if such a list should exist, enforcing it on founders will constitute a breach of contract as founders paid for a package ( contract) which includes access to an asset on a specified date. If Piranha would enforces such a list without clearly stating that in the contract it will open them to liabilities ( as they will have breached a contract with a customer)

so i highly doubt such a list exist or will even be enforced on paying customers

Every game I have ever seen with a running closed beta has an NDA. If they decide to change it, won't they simply change over to Open Beta?

If they modify the NDA, they would probably keep players silent, but the devs would start posting stuff for media releases and so on, at least that's what WoW would do. And then players could only talk about what was limited by the release by the dev posts and whathaveyou.

The point is this:

YOU are not allowed to state that you are in the beta.

PGI is perfectly allowed to state that you are in the beta. If they do so by saying "all Founders are in", and you have a Founder's badge, then people will know you are in the beta.

However, that still requires you to adhere strictly to the NDA until it is officially voided. That means, no posting about anything you see, hear or do in any place where the public can view it.

Just handle it like the US government: Just because it is general knowledge does not mean you can speak about it. It is still a binding legal contract until it has been waived by PGI. Yeah, sounds silly, but thems the beans.

Its very simple. When they allow me in to the Closed BETA because I have a founders pack. They will first require me to sign an NDA, before I will be completely allowed in.

It wouldn't be smart to lift the NDA entirely. Something doesn't work, beta people mention it here, hell breaks loose because concerned people will start crying here.
As for mentioning one is in the beta. Well, if you're a founder, you're in it past the 7.8. and everyone knows that so it's redundant to even mention it.

NDA should still be intact since it will still be Closed Beta. They may only modify the part where you can't tell people if you're in Beta or not, since it'd be a moot point for most.

Servers went in this morning if all is well the rest of us founders will go in this week. Any info for non founders will come after Aug 7.

Paying for a founders pack which comes with guaranteed beta access does not mean that we are somehow exempt from the NDA regardless of the fact that people can guess we are in by our founders tag.

People knowing we are in beta is irrelevant, however giving out information we would not have access to if we weren't in beta is not. So refrain from posting beta info on any but the beta forum and all will be well.

I think there will undoubtedly be a veritable flood of information circulating freely once NDA is lifted :)
