Mech would get a facelift anyways, so HG cannot sue PGI for using the name and stats.
Phoenix Hawk is perfect machine, it is fast enough to act as scout or scout hunter. We are really missing a good
jump capable medium, and Phoenix Hawk is the perfect fit for that category.
Furthermore, Phoenix Hawk has many, many variants which span for the entire Battletech timeline.
Give us the Phoenix Hawk!

As for them not having been announced yet meaning they will never appear in MWO.... that is one interpretation.
I prefer to think that the Unseen might be worked on as a package to be unloaded en masse some time after the game has "gone gold" and been active for a short while. Certainly amongst the fan community, being able to pay for early access to those designs could potentially be a significant moneymaker, and there is little reason to eke them out one at a time now and disperse the thunder, when that could be harnessed to make a large and loud impact on the game some time after it had gone live, and either well before or sometime after the arrival of the clans. For my money, that is how I figure the clans will arrive - a good number of mechs released en masse, and potential to pay for early access / faction change to the clans.

This game is going heavy against Hawken for the same mecha market, and to be honest this game is banking ALOT of it's nostalga factor.
If they really want to tap the Animu audience, which is and was the core MechWarrior demographic for 20 years, placing as many iconic mechs in the game at launch for promo's and open beta will only help them. Regardless on what tabletop sperg's say.
On another note, make mine a PHX Hawk. it will applease those slighted by the nerf of the lunchback.

NOTHING is stopping them from remaking the unseen. In fact they CAN use a "variation" of the original artwork as long as they change up to 25% of the original design. Changing the color and the proportions alone would legally be enough.
FlyingDebris's art style changed 50-75% of the design anyways.
Harmony Gold only own North American rights to the original artwork. Not artistic license remakes. Nor do they own the names of the battlemechs.
Anything FB makes would be 100% ok in a court of law.
