Copyright is automatic and covers anything you create by default.
Patent is expensive and lengthy process that requires working models and examples.

...so PGI can claim I already have it and not actually do anything with the model.

Back on topic - a lot of things in business end up similar to each other. Business want to minimize risks and so if something is working for Company A then almost certainly Company B will copy some or all of it. The effectiveness of this strategy decreases of course the number of times it is copied due to dilution leaving room for innovation once again. The key is to get as close to copying as you can without actually infringing on any copyrights
