Crowd funding is popular these days you cant say they copied that. Have you ever heared of kickstarter its a page which was made exactly for that purpose http://www.kickstarter.com/

As far as my limited knowledge of IP (Intellectual Property) and copywrite law goes, it's actually a question of IF PGI or IGP copywrited the founders packages if they did then yes they might have a case - considering the names they have used (legendary, elite etc) also if the ripped of any of the code for the website, that would be an IP case and while clear cut can be difficult to prove. either way someone needs to patent it or copywrite it before Apple does.

You have a copyright when you publish anything to the the public domain, but it only covers that specific work. In other words, we can't create Mechwarrior Online. However, this does not cover anything in historical or common use, such as ranks, titles, shapes, or colors. There is a copyright on the the way each of these mechs is styled, but not on 2 legged tanks.

A patent is bought on workable design. You cannot patent something that has no relevance, like a battlemech. It is too generic and non-functional. Nothing that PGI has done so far could be awarded a patent. But copyright law is enough to protect what has been created.

So, in short:

Copyright is automatic and covers anything you create by default.

Patent is expensive and lengthy process that requires working models and examples.

Careful, their website is tied to the game database. Upset Kyle and you might end up as non-founder with no mechs and 1337 cbills :P

Shucks, I was really hoping Splash Damage was going to make a new Wolfenstein game. Wolf:ET was one of the greatest games ever made, ET:Quake Wars was pretty good but not that successful, and Brink had great potential but ended up as a disaster. I don't regret paying Splash Damage after the free to play Wolf:ET (actually free to play, you couldn't pay money for it in any way), but they're products have been becoming less and less successful as they go along. After my experience with MWO and a few other free to play games I'm starting to think that I hate the business model as a whole and I'm doubting I'll be trying many more. The market is now saturated with these games and it just seems like for every game that's successful implementing it, there's 10-12 that fail miserably.

After checking out the gameplay and forums it looks a lot more W:ET and ET:QW and less Brink. Airstrikes are back anyway.

A white knight is someone who rushes to the defense of women being attacked on the internet. The term most likely originates from 4Chan where that kind of thing happens on a regular basis. So either PGI/IGP are women or it's not being used correctly.

Back on topic - a lot of things in business end up similar to each other. Business want to minimize risks and so if something is working for Company A then almost certainly Company B will copy some or all of it. The effectiveness of this strategy decreases of course the number of times it is copied due to dilution leaving room for innovation once again. The key is to get as close to copying as you can without actually infringing on any copyrights :(
