How Do I Go About Getting A Refund?

What I want to know is whether or not there is a cool down period and if I can get a refund on the MC I bought only 3 days ago?
Needless to say the recent forum developments have greatly dented my confidence in the future success of this product.
Any help would be greatly appreciated.

And you're less confident in MW:O now because of "the recent forum developments?" To what specifically are you referring?

7. Refund Policy
PlaySpan’s policy is that all sales processed by PlaySpan are final. Where PlaySpan acts as a Publisher’s payment agent, once you make a payment through the UltimatePay Service and such payment has been accepted by PlaySpan, there are no refunds provided except in PlaySpan’s sole discretion. You agree to provide any information reasonably requested by PlaySpan in connection with a refund request. If the Publisher is the “merchant of record” for a transaction (e.g., the Publisher processes the payment through its own merchant account and PlaySpan does not act as the Publisher’s limited payment agent), the Publisher is responsible for its own refund policy and you should consult the Publisher’s refund policy at the respective Publisher Site. In either case, PlaySpan does not represent or warrant that a refund can or will be provided by a Publisher. To the extent that we are unable to provide you a refund, we may issue you UltimatePoints.[/color]

PGI will not help you in this situation, only frustrate you with a PR statement meaning "NO".

By the way, you accepted the EULA after the last patch. If you didn't agree it's your own fault for accepting it without reading.

PS If I could get my founders refunded I would as well.

And now we have this thinly veiled attempt to remove any kind of criticism of their product on their very own public forums it's the final nail in the coffin for me.
I know I don't have much case for a refund. I thought that seeing as I only just bought the MC there might be something like a 10 day cool-down period like they have in retail transactions where you can return your product after 10 days if your not happy with it.
I think I'll just damn their impudence and wipe my hands of the whole sorry affair.

If the product that you paid for was MC and you got them then the transactions was performed correctly.

I'm not sure, does the current EULA have the famous EA clause of claiming immunity from class-action lawsuits as well?
Let me state this though: If someone bought the MC after the consumables were announced (and added), and after the possibility of 3rd person was announced, then even I don't think they should get their money back.
If a person knew for sure the game was already going in a direction they didn't like, and still paid for MC, you don't get to complain at some arbitrary later point in time and ask for a refund..

- We would never EVER think of bringing coolant in
- We would never bring in 3rd person, it would segment the players
- We would never let you give cash for damage
- There will be only 1 MC only mech type
- You won't be able to customize hero mechs
Yeah right. Forum posts aren't legally binding. I find this incredibly annoying and entitled, and Canada has almost exactly the same business practice laws, so go freaking sue them if you think you have any actual legal ground
To the OP: you could try talking to customer support, but you'll probably just get the "all sales are final" answer.

It could not hurt to ask, but I don't think they are obligated (either legally or ethically) to give you a refund.

If I advertise on TV, is it fraud? Newspaper ad? Craigslist? Ebay? A forum?
Aaanyway, I don't know about the legal **** involved, but again... if all these announcements came out, and someone already knew about them, and then that person still bought MC, they sure as hell have no right (legal or otherwise) to ask for a refund!

You were already informed this was a beta product, and could change at any time and in any way. Therefore there is no fraud. You assumed the risk when you agreed to pay for a beta product. A forum post is not a contract.

But I agree with you.
It was clearly stated that this is a beta product that could change at any time.
It would even be possible for a game developer to go under and disappear after people pay Founders bucks.. I assume the initial disclaimer made it clear that it's a possibility that the final product may differ (or indeed, may not exist at all).
Probably generally a good idea not to spend money you're not willing to lose on F2P kickstarted games. thanks to MWO, there's a lot of those these days.
As an aside, I've been messing around with a F2P game called Warframe on occasion, too, but I'm not about to spend a cent on it.
