Keep in mind, with these things, it doesn't matter if they would win or lose the lawsuit - the cost of defending a potential lawsuit is much too high to risk it. The moment a lawsuit was filed, PGI would lose a massive amount of money no matter what.
All in all, I think they did a marvelous job of keeping the feel of the originals, while creating new art that better fits MWO's style.
Gotta be honest... I agree with you 100%.
That being said, however...
An additional point to bear in mind is the history of the artwork. My (albeit limited) recollection is that the "unseen" mechs are those where the artwork in the TROs came from other franchises. In BT, the primary (and, for that matter, all other) weapons tended to be integral to the chassis sectors to which they were attached, whereas in the other franchises, the mechs tended to have more anthropomorphic hands and hold traditionally-shaped (albeit slightly bigger) pistols, rifles or swords as their primary weapons. As such, this redesign could be considered as a bit of a retcon to better fit in with the rest of the mechs in BT lore.
