I don't expect that everyone can be the Gray Death Legion, or Warrior House Imarra, but will people be able to recreate some of the smaller groups?

I assume they changed their mind, or their policy on canon units while you weren't looking. So there's still hope.

Personally, I'm aiming at the 6th Ghost Regiment, but I got a back-up name ready in case the Ghost Regiments are off-limits.
Say hello to the Yūrei-tai dai mu-dankai (Ghost-Unit of the 6th Stage)!

Faction units are being handled slightly different. How would/could any prospective Faction Player have an idea of what units will be available for joining at first log-in, and which will "require additional feats of excellence" to attain membership? What criteria are being or will be used to determine which (if any) feats/challenges are suitable/acceptable for which units?
As a Davion-oriented Faction Player, would any of (as examples) the College of Martial Sciences Cadet Cadre, Robinson Rangers, or Davion Brigade of Guards units be immediately available at first log-in? Or would/should it be expected to have to start in one of the March Militia units and work one's way up to a non-militia unit?
