You don't really want to play games with this sort of thing, and PGI/HBS know that, so they'd play it safe till it's sorted.

Please don't give them the idea to introduce the Avatar. The combination of low speed, easily hit STs and hardwired XL is just suicide. There is a reason nobody uses a Warhammer with the XL 280.
The Black Hawk-KU is indefinitely better when it comes to IS heavy OmniMechs.

The Black Hawk KU also has an XL engine...but at 5/8 MP and 60 tons it's probably not as risky.
Either case can just be solved with strong ST armor quirks if need be.

Upside: HG changed their wording to "copy," as opposed to derivative works. This means they need to prove to the court that, even if they claim they can fight that they own the rights, it is much, much harder for them to defend the premise of copy. Copy implies "100% duplication." Given A. it isn't, and B. "their" stuff is essentially 2-D vs PGI's 3D objects that had to be rendered in far greater detail from all angles, a sardonically uttered "good luck" would be an understatement.
Damned near impossible for HG to defend "copy." XD

The Black Hawk KU is indeed far more survivable being significantly faster (81 vs 64 kph in MWO terms), smaller, and having arguably better hitboxes. (I certainly prefer Nova-style over Mad Dog-style!).
Of course you can quirk the Avatar massively. Or the Uziel for that matter.
But then you could also just choose wisely. And between Avatar and Black Hawk KU it is not even a contest.

Besides durability, the BH-KU just offers the IS a role that it doesn't have right now: extreme small/medium laser boating. Only the Hunch 4P can kinda sorta do that now.

Of course, small lasers would have to appeal more to most people. The Hunchback-P pretty much hits the reasonable limit for IS medium laser boating at 8, anyway.

The Komodo could be interesting but it lacks tonnage compared to the BHawku but the comparison is being made for IS omnimechs so the Kom while an interesting med. Bmech they were talking about heavy omnis.

The next step up that isn't something like the BH-KU is probably the Flashman, which automatically at least hits 9E on the -8K, with the Jihad-era -9M being Civil War tech-capable and also mounting a withering 11E hardpoint layout stock.
Seriously. The -9M is twin HPPC, quad ML, quad MPL, and a small laser in case you didn't melt already firing the rest. It's an IS energy boater's wet dream- arms only have shoulder+upper actuators for maximum critspacing, 2E per arm, 3E per side torso and the head mount just in case you needed another place to stick something. It's about as good as it'd get for beamspam.

I prefer the Charger. It has more... character.
