And MW:O had a change in Management(no more IGP) after Phoenix IIRC. There is no Voice from Off screen saying, "DON'T answer that question!" any more. And PGI can do what it thinks is right because its right. Says so right here:

The phoenix camo is not enough of an incentive over mech bundles. Since no one would buy it why reopen an old wound.

You keep bringing up the TOS, but that covers content. Terms of sale are not content, and cannot be modified without consent of both parties.

There's basically three things that are unique and not available any more in the Phoenix pack:
1. The special geometry of the (P) 'mechs
2. The Loyalty Point medallions
3. The forum and in-game badges.
Since I have a hard time imagining anyone really, really wanting the forum and in-game badges, and the special geometry isn't all that special, I have to conclude that the continuing interest in the Phoenix pack is solely due to some people wanting the LP medallions.
Why don't you pester PGI for those directly?
